Regulatory Barriers in South Africa’s Renewable Energy Sector

Recent Government Standards to Address Bureaucratic Challenges
Responding to industry concerns, Forestry, Fisheries, and the Environment Minister Barbara Creecy introduced two standards aimed at easing bureaucratic hurdles:
- Battery Energy Storage Systems Exclusion Norm: Exempts certain activities related to battery storage facilities in environmentally sensitive areas from authorization requirements.
- Solar Exclusion Norm: Excludes solar PV facility activities in low or medium environmental sensitivity areas from authorization requirements.
Compliance Procedures and Environmental Protection Measures
To ensure compliance with environmental regulations, project developers must conduct site sensitivity verifications and engage in consultations with affected communities. Non-compliance may result in penalties under the National Environmental Management Act (Nema). Efficient navigation of regulatory processes not only expedites project approval but also fosters innovation and investment in renewable energy.
